DBx Knives — Terms of Service

These Terms of Service (“Terms”) govern your use of DBxKnives.com (the “Site”) and any purchase of DBx Knives products. By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, do not use the Site or purchase our products.
1. Eligibility & Age Verification
You must be at least 18 years of age to purchase products from DBx Knives. By placing an order, you represent and warrant that you are 18 years of age or older, and that you are aware of and will comply with all applicable federal, state, and local laws regarding the purchase, possession, carrying, and use of knives in your jurisdiction. DBx Knives is not responsible for verifying the laws of your specific location and assumes no liability for orders placed in violation of local law.
2. Intended Use
DBx Knives products are custom-fitted, hand-optimized chef knives designed and intended for safe food preparation purposes only. Use of any DBx Knives product for any purpose other than safe food preparation — including but not limited to as a weapon, pry tool, or for any activity involving lateral, twisting, or prying force on the blade — is outside the product’s intended use and is undertaken at the user’s own risk.
Each DBx Knives product’s handle-to-blade joint carries a maximum rated transfer force, which varies by handle size as stated in Section 5 and/or on the product label.
Use of a DBx Knives product for tasks that require handle-to-blade transfer forces beyond the rating stated in Section 5 or on the product label is not covered by the product warranty or these Terms’ liability limitations. Specialized culinary tools exist for these tasks.
3. Assumption of Risk
Use of any knife, including a DBx Knives product, carries an inherent risk of injury, including but not limited to cuts, punctures, and lacerations. By purchasing or using a DBx Knives product, you acknowledge and voluntarily assume these risks.
4. Product Care & Maintenance
The safety and performance characteristics described on this Site (including grip pressure, hand strain, and injury-risk reduction data from ABx Performance Testing) depend on the product being maintained in accordance with the Care & Maintenance instructions included with your product and/or available in the Care & Sharpening section of the DBxKnives website (DBxKnives.com). Improper maintenance — including failure to keep the blade sharpened, improper cleaning or storage, or use beyond the rated capacity stated on the product label or in this document — voids the product warranty and the liability limitations described in these Terms with respect to any harm resulting from that failure.
Sharpen only using diamond sharpening plates or stones, by hand, at the angles specified in the product’s sharpening protocol. Use of carbide or ceramic pull-through sharpeners on DBx Knives voids the warranty. At its discretion, DBx Knives may offer a rework and recertification service for damaged blades, where repair is possible.
5. Rated Capacity
Each DBx Knives product’s handle-to-blade joint is rated for a maximum handle-to-blade transfer force, as stated on the product label and/or in this document. Safe handle-to-blade transfer force is up to 4 Lb for knives with 80mm and smaller DBx handle sizes, and 5 Lb for knives with 82mm and larger DBx handle sizes, unless otherwise noted on the product label. Use involving handle-to-blade transfer force in excess of the rating stated on the product label or in this document falls outside the product’s intended use and is not covered by the product warranty or these Terms’ liability limitations.
6. Disclaimer of Warranties
Except as expressly stated in DBx Knives’ written product warranty, all products are provided “AS IS” and “AS AVAILABLE” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
7. Limitation of Liability
To the maximum extent permitted by law, DBx Knives, its founder, and its agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from your purchase or use of any DBx Knives product, whether based in warranty, contract, tort, or any other legal theory, even if DBx Knives has been advised of the possibility of such damages. Because some states or jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, in such states or jurisdictions DBx Knives’ liability is limited to the maximum extent permitted by law.
Nothing in this section waives or limits any claim arising from a manufacturing defect, design defect, or failure to warn, to the extent such a claim is recognized under applicable products-liability law. This limitation applies only to claims arising from ordinary negligence in the purchase, use, care, or maintenance of the product by the customer.
8. Indemnification
You agree to indemnify, defend, and hold harmless DBx Knives, its founder, and its agents from any claim or demand, including reasonable attorneys’ fees, made by any third party arising out of your use or misuse of a DBx Knives product, or your violation of these Terms or any applicable law.
9. Shipping
International orders are shipped at the customer’s risk. DBx Knives is not responsible for delays, seizure, or confiscation of shipments by customs authorities. Risk of loss passes to the customer upon delivery to the shipping address provided at checkout.
10. Right to Refuse Service
DBx Knives reserves the right to refuse or limit any order, at its sole discretion, including orders that appear to violate these Terms or applicable law.
11. Governing Law
These Terms are governed by the laws of the State of Maryland, without regard to its conflict-of-law provisions. If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.
12. Changes to These Terms
DBx Knives may revise these Terms at any time by updating this page. Continued use of the Site or purchase of products after changes are posted constitutes acceptance of the revised Terms.
